The agreement

These terms govern the use of the fluio3d.com website, the FLUIO. Organizer app for Windows and the 3D asset catalog (the “Service”), operated by FLUIO. By creating an account, subscribing or using the app, you agree to them and to the Privacy policy.

If you use the Service on behalf of a studio or company, you confirm you have authority to bind them to these terms.

What the Service is

FLUIO. Organizer is a Windows app that organizes your local library of 3D models and textures and integrates with 3ds Max. A subscription gives access to the cloud asset catalog, with a monthly download quota for models and textures defined by your plan.

Plans, prices, quotas and machines per license are those published on the plans page at the time of purchase. We may create, change or discontinue plans; changes do not affect a period already paid for.

Your account

• The account is personal and non-transferable. You are responsible for what happens in it and must keep your credentials confidential. We recommend enabling two-factor authentication.
• The license covers the number of machines in your plan. Sessions are visible in your panel and you can end any of them.
• Sharing the account, reselling access or circumventing the machine limit violates these terms.

Asset license

What you may not do:

• Redistribute, resell, sublicense, share or publish the asset files, in whole or in part, even if modified.
• Offer the assets as part of another library, marketplace, bundle or service.
• Scrape the catalog, preview images or metadata in an automated way outside the app.

The license is non-exclusive and transfers no intellectual property. If a rights holder disputes an asset, we may remove it from the catalog; use already made in completed projects is not affected.

Payment, renewal and cancellation

• Payments are processed by a third-party provider; we do not store card data.
• Monthly plan: renews automatically each period until you cancel. Cancellation applies to the next period; the current one stays active until it ends.
• Annual plan: one-time purchase, no automatic renewal. We notify you before it ends.
• The monthly download quota does not carry over between periods.
• Consumers in Brazil may withdraw from an online purchase within 7 days (Consumer Defense Code, art. 49) by writing to [email protected]. Downloads made during that period may be deducted proportionally from the refund.
• Non-payment suspends access to the catalog; your local library remains yours.

Acceptable use

You may not use the Service to violate laws or third-party rights; attempt to access other people's accounts, systems or data; interfere with the infrastructure; reverse-engineer the app or its licensing mechanisms; or automate downloads to circumvent the quota.

Violations may lead to suspension or termination of the account, without prejudice to other remedies.

The app

We grant you a limited, revocable, non-exclusive license to install and use FLUIO. Organizer on the machines in your plan. The app updates automatically through the channel it was installed from (website or Microsoft Store); staying on the minimum required version may be necessary to keep using the catalog.

Organizer reads and organizes files on your machine at your command. Back up your library: organizing operations move files and, while designed to be safe and reversible, depend on the state of your system.

Availability and liability

We work to keep the Service up, but it is provided “as is”: there may be maintenance, downtime and catalog changes. We do not guarantee that any specific asset remains available.

To the extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid in the 12 months before the event. Nothing in these terms removes consumer rights that cannot be waived by law.

Termination

You may close your account at any time from the panel or by e-mail. We may suspend or terminate accounts that violate these terms, with notice when possible. Termination does not affect the license of assets already used in projects, but ends access to the catalog and downloads.

Governing law and changes

These terms are governed by the laws of Brazil. Where consumer law so requires, disputes are heard in the courts of the consumer's domicile.

We may update these terms. Relevant changes are announced on the website and, when they affect your account, by e-mail with reasonable notice. Continuing to use the Service after they take effect means accepting the new version.
